Ahmet Nedim Erdem, Chairman of the Insurance Adjusters Executive Committee of the Union of Chambers and Commodity Exchanges of Türkiye (TOBB), which is the legal representative of insurance adjusters operating in Türkiye, warned against relying on malicious unauthorized persons who call citizens after a traffic accident and demand a power of attorney.

Ahmet Nedim Erdem, Chairman of the TOBB Insurance Adjusters Executive Committee, gave the following opinions in his written statement on the subject:

“As a result of a traffic accident, if your vehicle has suffered damage subject to loss of value and the other vehicle involved in the accident is at fault, loss of value compensation can be requested from the relevant insurance company within the scope of compulsory traffic insurance.

In order to obtain compensation for loss of value, the insurance company of the at-fault party must first be applied to. In general practice, submitting the petition, damage expertise report and photographs of the damaged vehicle to the insurance company via e-mail or cargo is sufficient for the application. In addition, if no results are obtained as a result of applying directly or to the insurance company, an application for loss of value can be made with e-government verification by following the “Online Transactions” and “Appointment of Expert” steps on the website of the Insurance Information and Surveillance Center at www.sbm.org.tr.

- Insurance Adjuster never requests a power of attorney from the insured or beneficiary 

By law, the insurance loss adjuster must be impartial and independent. For this reason, no insurance loss adjuster calls the insured or the beneficiary and requests a power of attorney stating that they will follow the loss of value or damage processes.

Following vehicle accidents, our Executive Committee has been notified that malicious individuals are using titles such as insurance expert, state expert, etc. to request power of attorney to carry out Vehicle Value Loss lawsuit processes. It is recommended that these individuals, who also capture your personal data, should not be trusted and should be reported to the relevant authorities so that legal proceedings can be taken.

If a person claims to be an insurance expert and asks you for a power of attorney, this is an attempt at fraud. People who call you with expressions such as “I am the expert of the state”, “I will take your loss of value”, “I will solve it without going to court” should not be trusted.

In order to take legal action against persons or companies operating under the names of damage consultancy firms, intermediaries and business followers, etc., which cause victimization of our citizens by operating in violation of the Attorneyship Law, the Union of Turkish Bar Associations (TBB) has prepared the “Notification Button” to make the necessary application and a complaint application can be made at the “Traffic Accident, Damage Consultancy, Intermediary and Follower Online Notification / Complaint Application Form (https://www.barobirlik.org.tr/AraciTakipciIhbar).

In addition, unauthorized persons calling under the name of expert can be reported to the sigortacilik@tobb.org.tr e-mail account of our Executive Committee.”
